TERMS OF SERVICE
These Terms of Service govern the use of the Monster Labs Studios website and the purchase of products through monsterlabsstudios.com.
The store and the Monster Labs Studios brand are operated by Cursed House Studios LLC, a Wyoming limited liability company. Our products are designed, manufactured, prepared, and fulfilled from our workshop in Buenos Aires, Argentina.
By accessing our website, placing an order, or purchasing a product, you agree to these Terms of Service, together with our Shipping Policy, Return & Refund Policy, Privacy Policy, and any other policies available on our website.
1. Our Products
Monster Labs Studios creates handmade collectible art pieces, oddities, sculptures, display specimens, and decorative objects inspired by folklore, mythology, fantasy, horror, and historical curiosities.
Unless specifically stated otherwise, our pieces are artistic reproductions and fictional or decorative creations. They are not represented as genuine archaeological, biological, medical, or historical specimens.
Because our products are individually handmade and hand-finished, minor variations in color, texture, finish, shape, positioning, and small details may occur from one piece to another. These variations are a normal part of handmade production and are not considered defects.
Product photographs are intended to represent our pieces as accurately as possible, but colors and appearance may vary slightly depending on lighting, photography, and screen settings.
2. Product Availability
Products may be made to order, available from existing stock, offered as limited editions, or sold through preorder.
Availability displayed on the website may change without notice.
We reserve the right to discontinue products, limit quantities, or refuse an order if a product becomes unavailable or if we identify an error in its listing, price, availability, or other information.
If we are unable to fulfill a paid order, we will contact the customer and provide an appropriate refund.
3. Production Time
Most Monster Labs Studios pieces are handmade to order and normally require approximately 1-3 weeks to craft before dispatch.
Items that are currently in stock may ship sooner.
Preorder items may have different production or dispatch schedules. When a specific production or estimated shipping date is stated on a preorder product page, that information takes precedence over our standard production timeframe.
Production estimates are provided in good faith but may occasionally be affected by material availability, production complexity, order volume, or other circumstances outside our reasonable control.
4. Prices and Payments
All prices displayed on our store are shown in the currency indicated on the website at the time of purchase.
Available payment methods may vary depending on the customer's country, device, currency, or checkout configuration.
Payment must be successfully authorized before an order can be processed.
We reserve the right to cancel or review orders that are flagged by our payment providers or fraud prevention systems.
Any currency conversion charges, foreign transaction fees, bank fees, or similar charges imposed by the customer's financial institution are not collected or controlled by Monster Labs Studios.
5. Order Confirmation and Acceptance
After completing checkout, customers normally receive an order confirmation by email.
An order confirmation confirms that we have received the order. We reserve the right to review an order before accepting it for production or fulfillment.
We may contact the customer if additional information is required to process the order, including shipping details, telephone number, payment verification, or information required by the carrier or customs authorities.
Customers are responsible for providing complete and accurate billing, contact, and shipping information.
6. Order Changes and Cancellations
Because many of our products are handmade specifically for each order, production may begin shortly after purchase.
If you need to request a change or cancellation, please contact us as soon as possible at sales@monsterlabsstudios.com.
Cancellation or modification requests are not guaranteed and may depend on whether production or fulfillment has already begun.
Once an order has been dispatched, it cannot be cancelled and any applicable return request will be governed by our Return & Refund Policy.
Nothing in this section limits any mandatory cancellation rights that may apply under applicable consumer law.
7. Shipping & Delivery
We ship worldwide from our workshop in Buenos Aires, Argentina.
Orders are securely packed and shipped via FedEx with full tracking.
Tracking information is provided once the shipment has been dispatched.
Estimated international transit time is generally 4-12 business days after dispatch, depending on the destination, customs clearance, local carrier conditions, and other circumstances outside our direct control.
Orders to the United States typically arrive within approximately 4-5 business days after dispatch, although this is an estimate and not a guaranteed delivery timeframe.
Delivery dates and transit times are estimates only.
8. Shipping Charges, Customs & Additional Fees
The shipping amount paid at checkout covers transportation only.
It does not include import duties, taxes, customs clearance charges, brokerage fees, disbursement fees, handling fees, storage fees, or any other destination or carrier charges that may later be assessed by FedEx, customs authorities, government agencies, or local authorities.
Any such additional charges, when applicable, are the responsibility of the buyer.
Monster Labs Studios does not control, determine, collect, or receive these additional charges.
Customers are responsible for checking any applicable import requirements, taxes, duties, or restrictions in their destination country before placing an order.
A customer's refusal to pay customs duties, taxes, carrier fees, or other destination charges does not make those charges the responsibility of Monster Labs Studios.
9. Customs and Import Regulations
International shipments may be inspected or delayed by customs authorities.
Customers are responsible for ensuring that the products they order may legally be imported into their destination country.
We provide the documentation reasonably required for international shipment, but we cannot guarantee the timing or outcome of customs clearance.
Customs processing or inspections may occasionally extend delivery times.
10. Shipping Delays, Loss or Damage in Transit
Carrier and customs delays may occasionally occur outside our direct control.
If a shipment is significantly delayed, lost, or damaged in transit, please contact us at sales@monsterlabsstudios.com.
We will assist with the FedEx or carrier claim and work with the customer toward an appropriate resolution.
Customers should retain all shipping packaging when reporting an item damaged in transit, as photographs or inspection of the packaging may be required by the carrier.
11. Damaged or Defective Products
We accept returns or exchanges only for products that arrive damaged or defective.
Customers must contact us within 7 days of delivery to report a damaged or defective item.
The claim should include:
- the order number;
- clear photographs of the item;
- clear photographs showing the damage or defect;
- photographs of the shipping packaging when applicable.
Please do not return an item before contacting us and receiving instructions.
Once the issue has been evaluated, Monster Labs Studios will determine the appropriate resolution, which may include repair, replacement, return, or refund depending on the circumstances.
12. Returns
We do not accept returns or exchanges due to change of mind.
When a return is required and approved by Monster Labs Studios, the item must be shipped back within 21 days of delivery, unless otherwise agreed with us.
The item must be returned in the condition in which it was received, with its original packaging and all included components.
Return shipping costs are the responsibility of the buyer, unless otherwise agreed in writing with Monster Labs Studios.

13. Refunds
When a refund is approved, it will be processed to the original payment method.
Original shipping charges are non-refundable unless otherwise agreed or required by applicable law.
Import duties, taxes, customs clearance charges, brokerage fees, disbursement fees, handling fees, storage fees, and other destination or carrier charges are also non-refundable because these amounts are not collected or received by Monster Labs Studios.
Processing times after a refund has been issued may vary depending on the payment provider or financial institution.
14. Handmade Variations
Every Monster Labs Studios piece is individually handmade and hand-finished.
Minor differences in color, texture, finish, weathering, positioning, assembly, paint application, or small details are normal characteristics of handmade artwork and do not constitute defects.
These variations make each piece individually finished rather than mass-produced.
15. Website Information
We make reasonable efforts to ensure that product descriptions, prices, dimensions, photographs, availability, shipping information, and other website content are accurate.
However, occasional typographical errors, inaccuracies, or omissions may occur.
We reserve the right to correct errors, update information, or modify listings at any time.
If a material error affects an order already placed, we will contact the customer when appropriate.
16. Intellectual Property
All original content available through Monster Labs Studios, including product designs, sculptures, photographs, graphics, logos, written content, artwork, branding, and other original materials, is owned by or licensed to Monster Labs Studios unless otherwise stated.
Purchasing a physical product does not transfer intellectual property rights in its design.
Content from our website may not be reproduced, copied, commercially distributed, manufactured, resold as a reproduction, or used to create derivative commercial products without prior written authorization.
17. Personal and Commercial Use
Products sold through our retail store are intended primarily as collectible artwork and decorative objects.
Retail customers may resell legitimately purchased physical pieces as personal property, but may not reproduce, manufacture, cast, scan, digitally reproduce, or commercially copy our designs without authorization.
Businesses interested in purchasing products for retail resale should contact us regarding wholesale availability.
18. Third-Party Services
Our website may use or link to third-party services including Shopify, Shopify Payments, PayPal, FedEx, analytics providers, social networks, and other service providers.
Certain transactions or services may therefore also be subject to the terms and privacy policies of those providers.
Monster Labs Studios does not control the independent operation of third-party websites or services.
19. Prohibited Use
You may not use our website or services for unlawful, fraudulent, abusive, or unauthorized purposes.
You may not attempt to interfere with the security or operation of the website, introduce malicious software, obtain unauthorized access to systems or customer information, or use our content in violation of intellectual property laws.
We reserve the right to restrict access or cancel transactions associated with suspected fraud, abuse, or unlawful activity.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Monster Labs Studios will not be liable for indirect, incidental, consequential, or special damages arising from the use of our website or products.
We are not responsible for delays caused by customs authorities, government agencies, severe weather, transportation disruptions, force majeure events, incorrect information supplied by the customer, or other circumstances outside our reasonable control.
This limitation does not exclude or restrict liability that cannot legally be excluded under applicable consumer protection law.
21. Force Majeure
Monster Labs Studios will not be considered in breach of these Terms for delays or failures caused by events reasonably outside our control, including natural disasters, severe weather, war, civil disturbances, government restrictions, transportation disruptions, carrier interruptions, customs actions, strikes, power failures, internet outages, or significant supply disruptions.
We will make reasonable efforts to minimize the effect of such events on affected orders.
22. Privacy
Personal information submitted through our store is handled in accordance with our Privacy Policy.
Payment information may be processed directly by Shopify Payments, PayPal, or other payment providers made available through our checkout. Monster Labs Studios does not directly store complete credit or debit card information submitted through those providers.
23. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes to our products, services, policies, legal requirements, or business operations.
The version published on our website at the time of an order will generally apply to that transaction, subject to mandatory applicable law.
24. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
25. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws principles, except to the extent that mandatory consumer protection laws in a customer's country or jurisdiction apply and cannot legally be excluded.
Nothing in these Terms is intended to exclude rights that cannot legally be excluded or limited.
